When you can’t get your money back after your dental work: Family fare and family law
A family law lawyer in the state of Washington said he and his wife are fighting to get back the money they received for their dental work after a judge ordered the state to pay them.
“We’re still struggling,” said Steve Gresham, a family law attorney in Everett, Wash., and a member of the State Dental Association.
“We’ve had the dental and the x-rays, but we’ve been stuck in the process of trying to get our money back.”
Gresham said he had received his dental work at the state’s Department of Health and Human Services office and was on his way home to Seattle when the judge issued the ruling.
“I got the phone call that my wife had been declared disabled and that the state had issued a warrant for my arrest,” Gresam said.
“It was very emotional.
It was very stressful.
My wife had had a seizure.
She was extremely frightened.”
Grosham and his two children, ages 3 and 10, were at home when the warrant was issued, and the judge asked them to stay with their mother and sister.
Gresam says he and the children were taken into custody without incident, but Gresams wife is not allowed to see her family.
“It’s very hard to say, ‘Sorry, we don’t have the money,'” Gresum said.
“They took us into custody, and they did everything they could to take our money.
They did all they could.
They put us in a holding cell with nothing to do.”
Gesham has not been allowed to pay the $3,500 to $4,000 he was ordered to pay to the state.
His case is currently being heard by the court clerk.
“My wife has not received any money from the state,” Grosham said.
Guskin says there are currently two other families that are also stuck in this situation.
“A family lawyer in Pennsylvania is having to fight for a lot of money,” Guskin said.
That lawyer is a family doctor who is working with a woman who is also a patient of the family law office, Gresman said.
That doctor says he was given a $2,500 check from the Department of Children and Families, but has been unable to get it.
Grosman said he has not filed a lawsuit against the state yet, but he is hoping to soon.
Gesam and his family are trying to win back their money.
He said he will not give up and is looking for other families to join him.
“The state needs to be held accountable for this,” Gesam said, adding that if there is not an apology from the department, there will be no recourse.
The state of California has taken legal action against the department for its failure to respond to a lawsuit brought by Gresamphe in December.
Gresamps lawyer said the state has failed to respond because the state failed to provide adequate documentation that a person with a disability has a disability and that a judge should be able to order the state in this case to provide them with the documentation.
Gersam said the department should have immediately provided him with the documents he requested.
“If they’re not going to do it, I think the court should take action,” Gersam added.
Gosham has said he believes the state should be held liable for failing to provide the required documentation.
“Our family had no reason to believe that our money would be stolen,” Gosam said of the state dental office.
“I’m still trying to understand why it was not disclosed to us.
We were told the money would not be taken from us.”
